Hype Ten (OPC) Private Limited (“Company”) respects your right to privacy. This policy summarises what personally identifiable information we may collect, and how we might use this information. This policy also describes other important topics relating to your privacy.

Company Global Mobile Application Privacy Policy

It is Company policy to comply with all applicable privacy and data protection laws. This commitment reflects the value we place on earning and keeping the trust of our employees, customers, business partners and others who share their personal information with us.

This Global Mobile Application Privacy Policy (this ‘Policy’) describes how Company protects your privacy when we collect personal information on the Company’s mobile application Parq and associated pages and forms (“Company App”). As used in this Policy, the term ‘personal information’ refers to information that identifies you personally, alone or in combination with other information available to us.

App Privacy Statements

This Policy applies to only the Company App generally. The Company may have other applications with different purposes and different features. If additional or different disclosures are required with respect to a specific Company application, we will provide those disclosures on such Company application itself or in a separate privacy statement (‘Privacy Statement’) posted on that application. Each individual disclosure or Privacy Statement supplements and amends this Policy, but only with respect to the application on which it is posted.

Your Consent

By using the Company App or providing personal information to us, you are consenting to the collection, use and disclosure of your personal information as described in this Policy and any applicable Country or App Privacy Statements.

If you do not consent to the collection, use and disclosure of your personal information as described in this Policy (and any applicable Country or App Privacy Statements), do not use Company App. You may in such a case reach out to the Company with your concerns.

Limitations on the Collection, Use and Disclosure of Personal Information

To the extent required by applicable law, whenever Company collects personal information on a Company App, Company will:

• provide timely and appropriate notice to you about its data practices;

• collect your personal information only for specific, limited purposes. The information we collect will be relevant, adequate and not excessive for the purposes for which it is collected;

• process your personal information in a manner consistent with the purposes for which it was originally collected or to which you have subsequently consented;

• take commercially reasonable steps to ensure that your personal information is reliable for its intended use, accurate, complete, and, where necessary, kept up-to-date;

• not use your personal information for direct marketing purposes without giving you an opportunity to “opt-out”; and

• take appropriate measures, by contract or otherwise, to provide adequate protection for personal information that is disclosed to a third party or transferred to another country, including transfers within Company.

The Company shall in addition to the above attempt to alert you every time if personal information is collected from you and seek your active consent for storage, use and processing of such personal information in accordance with applicable law and international best practices. However, you acknowledge that when you are required to actively provide the Company with personal information while using Company’s services, it is presumed that the Company may use, store and process such information for rendering the services and no additional consent is required from you for this purpose.

Information Collected on Company APPs and How It May Be Used

When you access and use a Company App including the App, there are 3 ways we may collect information about you:

1. Information Sent to Us by Your Phone

Company collects information that is sent to us automatically by your phone. This information typically includes information about your phone, its operating system (such as (such as Android Jelly Bean® or Android Lollipop®) and the name and version of your browser (such as Chrome® or Safari®). In addition to the above, we may collect your location information with your permission only while you are using the App. The information we receive depends on the settings of your phone. Please check the relevant section on your phone to check the App permissions and the information we collect if you want to learn what information your phone sends or how to change your settings.

The information provided by your browser does not identify you personally. We use this information to create statistics that help us improve our APPs and make them more compatible with the technology used by our online visitors.

2. Information we collect based on your usage of the App

The App may store information of your sessions on the App including your parking history, the time taken to park your vehicle and retrieve your vehicle each time you used the App. We use this information to collate statistical information about the ways visitors use our Apps – which functionalities they use, which links they use and how long they take to complete an action on the App. We analyse this information in statistical form to better understand our visitors’ interests and needs to improve the content and functionality of our Apps.

We use this information to give feedback to the Valet Service Providers regarding their staff, the general level of their services and to help their service and improve your experience with them.

We also use this information to settle any disputes that might arise between you and the Valet Service Providers.

The Company App may also by use of cookies enable storage of your login and password details in the local storage of your phone / device or on the Company’s servers to streamline your login process into the Company App so that you do not have to enter your login information every time you access the Company App.

3. Information You Knowingly and Voluntarily Provide

Company collects the information you knowingly and voluntarily provide when you use a Company App, for example, the information you provide when you sign up to receive sms alerts, the information you provide regarding your vehicle for generation of your e-parking ticket. This information may be personal information under applicable laws.

Company uses this information for the purposes for which you provide it. For example, if you provide your vehicle’s registration number, model and make – we use it to generate e-parking tickets for you and simplify the process of using the valet services on subsequent parking attempts. We may also use the information we collect on the Company App for various business purposes such as customer service, fraud prevention, market research, improving our products and services and providing you with information and offers we believe may be of interest to you. We may also remove all the personally identifiable information and use the rest for historical, statistical or scientific purposes.

The Company App permits you to make choices about the use of your personal information. In most cases, we ask you to indicate your choices at the time and on the page where you provide your personal information.

4. Information we do not collect or store

We do not collect information like your age, gender, address or payment information etc. and we do not collect any information other than those covered in paragraphs 1, 2 and 3 above.

Sharing Personal Information

Company will not sell personal information collected from the Company App to mailing list brokers without your express consent.

Company may share your personal information with other Company business units. When we do so, these other Company business units will use your information in a manner consistent with the purposes for which it was originally collected (or to which you subsequently consented) and only as permitted under this Policy, any applicable Country or App Privacy Statements, and all applicable privacy and data protection laws.

Company may also share your personal information with the Valet Service Providers you contract with. This is essential for the provisioning of the valet parking service. In addition to that, your personal information may be shared with and stored by third-party technology providers who develop and maintain the Company App. These third parties are required to use the personal information we share with them only to perform services on our behalf and to treat your personal information as strictly confidential.

In some cases, Company may share your personal information with third parties who partner with us to provide products and services to our customers. When we do so, we will require our business partners to use the personal information we share with them in a manner consistent with the purposes for which it was originally collected (or to which you subsequently consented) and only as permitted under this Policy, any applicable Country or App Privacy Statements, and all applicable privacy and data protection laws.

In certain, limited circumstances we may share or transfer personal information to unrelated third parties. For example, we may provide personal information to a third party (i) at your request; (ii) to comply with a legal requirement or court order; (iii) to investigate a possible crime, such as identity theft; (iv) in connection with the sale, purchase, merger, reorganisation, liquidation or dissolution of Company or a Company business unit; or (v) under similar circumstances. If such an event occurs, we will take appropriate steps to protect your personal information. The Company App permits you to make choices about the disclosure and/or transfer of your personal information. In most cases, we ask you to indicate your choices at the time and on the page where you provide your personal information.

Security of Personal Information

Your personal information will generally be stored in Company databases or databases maintained by our service providers. Most of these databases are stored on servers located in India. To the extent required by law, if your personal information will be transferred outside your country, an appropriate notice will be provided.

Company maintains reasonable safeguards to protect the confidentiality, security and integrity of your personal information. For example, we use secure socket layer (SSL) technology to transfer personal information over the internet. Although we use security measures to help protect your personal information against unauthorised disclosure, misuse or alteration, as is the case with all device networks linked to the internet, we cannot guarantee the security of information provided over the internet and will not be responsible for breaches of security beyond our reasonable control.

Links to Third Party APPs

The Company App may contain links to other web-pages or mobile applications that are not operated by Company. These links are provided as a service and do not imply any endorsement of the activities or content of these pages / applications, nor any association with their operators. Company does not control these pages / applications and is not responsible for their content, security or privacy practices. We urge you to review the privacy policy posted on the pages / applications you visit before using such page / application or providing personal information.

Access to Personal Information

You may review, correct and update the personal information that you provide to us via a Company App by using the feedback mechanisms provided on the Company App, by editing your account information at any time by simply logging in to the account, by clicking on this feedback link or by writing to us at following e-mail address hello@goparq.app.

Retention of Personal Information

Company retains the personal information collected on Company APPs as long as necessary to provide the services, products and information you request, provide backup evidence in case of disputes between you and the Valet Service Providers or as permitted by applicable law. You could at any time request deletion of your personal information from our records by writing to us, we will inform you if we hold any personal information of yours and if satisfied that the request for deletion is indeed from you, we will delete any stored personal information of yours from your records. Any request for amendments to or deletion of personal information should be addressed to hello@goparq.app. The Company shall in certain cases even if you delete your account on the Company App may still store your information to enable you to revive your account without the need to enter your personal information again. If you however wish that the Company completely purge its records of such personal information, you must make a specific request in this regard by writing to the Company at the above email address.

Children and Parents

The Company App is not generally intended for persons under 18 years of age. The Company does not knowingly solicit or collect personal information from or about children on its Apps except as permitted under applicable law. If your child has submitted personal information and you would like to request that such information be deleted from our records, you may do so by writing to us at the following email address hello@goparq.app.

Changes to this Policy and our Privacy Statements

Company reserves the right to update or modify this Policy, at any time and without prior notice, by posting the revised version of this Policy on the Company App. We also reserve the right to update or modify our Privacy Statements, at any time and without prior notice, by posting the revised Privacy Statement on the relevant Company App. If we modify this Policy or any Privacy Statement, the modifications will only apply to the personal information we collect after we have posted the revised Policy or Privacy Statement on the Company App.
